Out of curiosity and as an Elite Member I had a look for you in the Ninjatrader 6.5, 7, and 8 Downloads/Indicators folders for "Demark" as an indicator title or description and the search came up...

If there was a ban Mike would have clearly stated...

If there was a ban Mike would have clearly stated it and the reason why. Therefore I would say there isn't.
I can't think of any conversation or original thread that Mike has banned or locked on...
