I recently had a look at the NT8 terms of service document contained in C:\Program Files (x86)\NinjaTrader 8\bin section 10. Privacy.
I wanted to raise my questions/concerns publically to encourage debate and interest and would ideally appreciate a response from Raymond the CEO of Ninjatrader here as this is something dear to traders hearts.
The 2 sections that I would like clarity on are:
"a. General. When reasonably practicable, Company shall attempt to respect and maintain User’s privacy. Company shall not monitor, edit, or disclose any personal information about User or User’s account, including its contents or User’s use of the Platform, without User’s prior written consent unless Company has a good faith belief that such action is necessary to: (i) comply with any legal process or other legal requirements of any governmental authority, (ii) protect and defend the rights, interests, or property of Company, (iii) enforce this Agreement, (iv) protect the interests of users of the Platform other than User or any other person, entity, partnership, organization, association or otherwise, or (v) operate or conduct maintenance and repair of Company’s services or equipment, including the Platform as authorized by law. User has no expectation of privacy with respect to the Internet in general. User’s IP address and Platform generated GUID is transmitted and recorded with each User session."
Specifically what information do you have the ability "monitor, edit or disclose" in the circustances above. I am concerned about what private information Ninjatrader platform has access to and/or is regularly sending from my computer. My main concern, and I'm sure that of many here, will be how safe any propietry code is on the platform, does NT have the capability to see/copy privately coded indicators, strategies etc
g. Audits. Company may gain access to customers account/trading records for auditing purposes. Such records may be disclosed to an independent audit source. Reasonable and industry appropriate non-disclosure agreement(s) shall pertain to third party auditing sources. Some configurations of Platform may transmit trade execution data over the Internet to a secure database for the purpose of audit tracking.
Why and how would NT8 access our trading records? For what type of auditing purpose would my trades serve and what is the justification for NT8 logging such private information? Specifically, what information within the trading records does NT8 have access to?
Finally, I undersatnd NT promotes obfuscation of custom script via 3rd part partner but could NT confirm whther or not they or the 3rd party could be able to reverse the encrytion as they may access to the decrytion keys via the 3rd party.
As I mentioned, I would appreciate a response from Raymond the NT CEO on this as it extremely important to traders. I look forward to a response and input from forum users. I hope/expect that part of the response will include assurances that only in the most exreme cases would this happen, however I still would like to know spcifically what information the NT8 platform has access to that it could potential collect.

Whatever information you have provided to NinjaTrader to register/purchase a license such as your contact information. We do not have access to any proprietary code NinjaScript objects of any kind.
For non-NinjaTrader Brokerage customers, we transmit trade data to our servers for ONLY those customers who have elected to use the Static SuperDOM and have purchased TT Credits from us. If you have not done this, then trade data is not collected. This subset of customers represents maybe less than 1% of our customers. This data is used to calculate royalty payments that are charged to us (on a per trade basis) to the licensor of the static SuperDOM.
I can confirm that we or the 3rd party cannot.

The TOSA references monitoring this information, why and how do you monitor information if it has already been provided to you. Is there any other information that is monitored by NT8?
It says we do NOT monitor unless required for reasons specified in the TOSA, such as as legal required to do so. That said, this is broad legal language chosen by a lawyer for specific reasons. Usually, the drafter of a contract will want language to be as broad as possible.

Thank you, yes I understand that. What I am asking is in the event that their is a legal requirement to monitor, what information is NT8 capable of monitoring.
