Jan 27th was original purchase? When did you start the dispute because I thought it's capped at 180 days.

Or did you just get in the dispute before the 180 days but it took the dispute 90 days to finally settle?

The paypal cut off is 180 days, so I went directly to my CC provider with the claim. Oddly enough I was kicked out at 186 days after my first purchase, which I thought was weird timing. Must have been coincidence. Anyways, the case was obviously strong enough because I still had 6 months on my license and Vinny violated his own license agreement.

If you go through the install process of Algobox, under section 8 of his own License Agreement, it reads:

Luckily for me I'm smart enough to read the terms and uderstand EXACTLY what I was purchasing, and when I was denied access to my purchase for some nonsense I NEVER AGREED TO, like some off the cuff interpretation of terms, that was enough to get my refund.

For example, one of Vinny's excuses for banning me was because I shared a 3rd party tool in his group, and he claimed the reason for banning 3rd party links was due to technical compatibility issues and the fact that his technical support could potentially be flooded with requests if Algobox users install third party tools outside Algobox and they have technical issues. However, this is not mentioned ANYWHERE in his terms we both agreed to.

In the actual terms of service on his website, under the "self promoting" clause, it states that 3rd party links are banned for the following reason:

"This is in place to prevent this community and its members from being approached by others soliciting for a current or future business or following. This will not be a place for people to snipe members for a business or online following."

Additionally, his terms defines a 3rd party link as the following:
"No external links or mentions promoting your own personal following on social media, brands you are representing, or third party representations that can potentially compete with AlgoBox . No reference to any competing brands (monetized or unmonetized) are allowed whatsoever to be represented in AlgoBox's forums or chatrooms without written permission from AlgoBox."

Since my link was to a simple labeled lines tool developed by NinjaTrader:
1) the tool I linked to was in no way competing with Algobox
2) I was not representing Ninjatrader or any other brand
3) I was not soliciting members for current or future business


For these reasons, me simply sharing a 3rd party link was NOT in violation of his terms whatsoever. It was Vinny who just made up an interpretation of his own policy on the fly as an excuse to boot me because I didn't immediately kiss his ass and instead exercised my rights under the agreement. Lastly, I provided evidence that I was kicked out in retaliation for my review posts here and on Twitter, which obviously is wrong and maybe even illegal.

Everyone (Vinny included) should read the terms and understand what it is they are agreeing to.

Thank you for sharing, and it is all interesting, but really the most important takeaway I think is what kind of an account do you have with Goldman Sachs Bank? Is it the Apple Card, Marcus Checking account, or something else?

At the end of the day the whole deep dive into terms and conditions really doesn't matter because online transaction consumer protection is very strong in the US, and you can pretty much always win a chargeback just by selecting the correct reason for it. BUT, all credit cards I know have an cut off policy of 180 days or less after the charge.

So I'm wondering what kind of account was it? Perhaps they offer additional protections beyond the period and they ended up refunded you from their own pocket instead of taking it out of Vinny's merchant account.

I find ICT hilarious. The guru that that touts the Robbins Cup failed 4x. Vinny accepts the invitation and Michael as usual is a no show. Lol
